Following a number of contentious incidents, China has proposed a set of new guidelines aimed to institutionalize the legal underpinnings for self-defense in court cases, signifying an effort to foster a more just legal system. On Thursday, the Supreme People’s Court, the Supreme People’s Procuratorate, and the Ministry of Public Security announced 22 rules on the use of self-defense. While the guidelines will not provide law enforcement personnel with final answers in specific cases, they will clarify the underlying legal issues involved. According to JiangQiaoo, director of the Supreme People’s Court’s research office, this is an attempt to remedy some of the flawed reasoning that is prone to ruling out self-defense. According to Jiang, certain incidents may not appear to support a self-defense justification at first glance and must be thoroughly investigated before law enforcement authorities rush to judgment. “The defender’s mental state and the stress that he or she may be under when confronted with an illegal infringement must be considered,” he added.
